1. Acceptance of Terms

By accessing or using InfluenceKit ("Service", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By creating an account, you confirm that you are at least 18 years of age and have the legal capacity to enter into this agreement.

2. Description of Service

InfluenceKit is an AI-powered influencer and creator business management platform designed for content creators and influencers in the MENA region. The Service includes:

• Brand deal tracking and management
• AI-powered contract negotiation analysis
• AI-generated media kit creation
• Invoice generation and management
• Analytics and performance tracking
• Rate calculation tools

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. User Accounts & Responsibilities

To use InfluenceKit, you must register for an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain the security of your password and account
• Promptly notify us of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

You may not use the Service for any unlawful purpose or in a way that violates these Terms. We reserve the right to terminate accounts that violate these Terms.

4. Subscriptions & Payments

InfluenceKit offers the following subscription plans, priced in Qatari Riyals (QAR):

Subscriptions are billed monthly on the anniversary of your subscription start date. Payments are processed securely through Paddle. By providing payment information, you authorize us to charge your payment method for the applicable subscription fees.

All prices are in QAR and inclusive of applicable taxes. We reserve the right to change subscription pricing with 30 days' notice to existing subscribers.

5. Free Trial

New subscribers on paid plans are eligible for a 7-day free trial. During the trial period:

• You have full access to all features of your chosen plan
• No payment is charged until the trial ends
• You may cancel at any time before the trial ends without being charged
• If you do not cancel, your subscription will automatically begin and your payment method will be charged

Each user is eligible for one free trial per plan. We reserve the right to modify or discontinue the free trial offer at any time.

6. Cancellation & Refunds

You may cancel your subscription at any time through your billing portal. Upon cancellation:

• Your subscription remains active until the end of the current billing period
• No further charges will be made
• Your data remains accessible until the end of the billing period

Refund Policy

We generally do not offer refunds after the free trial period has ended. Exceptions may be made at our sole discretion in cases of:

• Technical issues that prevent access to the Service for more than 48 consecutive hours and cannot be resolved
• Duplicate charges due to payment processing errors

7. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of InfluenceKit and its licensors. Our trademarks, logo, and service name may not be used without our prior written consent.

You retain ownership of all content you create and upload to the Service. By using the Service, you grant us a limited license to process and display your content solely to provide the Service to you.

AI-generated content produced by the Service (such as media kits and negotiation analyses) is provided to you for your use, subject to these Terms.

8. Privacy & Data

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.

We implement industry-standard security measures to protect your data. However, no method of transmission over the Internet is 100% secure, and we cannot guarantee absolute security.

9. Limitation of Liability

To the maximum extent permitted by applicable law, InfluenceKit shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Qatar, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Qatar.
